Stake Merch Giveaway Terms & Conditions
Overview
From time to time Stakeshop Pty Ltd (Stake) may offer Stake merchandise as a prize (Prize) for a promotional giveaway or competition (Merch Promotion). By participating in any such Merch Promotion, you agree to be bound by these terms and conditions.
Eligibility Criteria
In order to qualify for a Merch Promotion you must ensure you meet the eligibility criteria specified in the particular Merch Promotion. Additionally, you must be over 18 years of age and be a resident of Australia. If you have met all of the eligibility criteria within the applicable Merch Promotion running dates, you will be considered an entrant into the applicable Merch Promotion to win the relevant Stake merchandise.
If you are required to post on social media to be eligible for a specific Merch Promotion, your profile must be public.
Entry is not open to any directors, employees, officers or contractors of Stake, or their families.
Winner Selection & Notification
Within one (1) week of the end date of the applicable Merch Promotion, the Stake Marketing Team will select the winner(s) based on the selection criteria applicable to the particular Merch Promotion and contact the winner(s) directly either by email or social media direct message.
Stake will make reasonable efforts to contact the winner(s). If the winner(s) do not confirm acceptance of the Prize within two (2) weeks of the end date of the applicable Merch Promotion, the Stake Marketing Team will select another winner and contact them to arrange delivery of the Prize.
Selection of the winner(s) by Stake is final and not subject to review.
Prize
The Prize the winner(s) will receive is selected Stake merchandise. The specific Stake merchandise the winner(s) will receive may vary and is subject to availability of sizes and styles. If the specific merchandise promoted is unavailable, alternative merchandise or a prize of at least equivalent value shall be offered at Stake's sole discretion. Prizes are not transferable and no cash alternative will be offered.
Restrictions
Customers are not eligible to set up multiple accounts to claim more than one entry into the applicable Merch Promotion. For the avoidance of doubt, only 1 entry per person under a Merch Promotion is allowed, unless expressly stated otherwise.
No Affiliation
This promotion is not sponsored, endorsed or administered by, or associated with the social media platform on which it may be promoted. By participating in this promotion you agree to release the applicable social media platform from all claims.
Privacy
Entrants' personal information may be collected by Stake to enable them to participate in this Merch Promotion. Personal information collected as part of this promotion will be handled in accordance with our Privacy Policy, which includes using personal information for marketing purposes. Stake is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its Privacy Policy.
Limitation of Liability
Stake will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered (whether or not arising from any person's negligence or wilful misconduct) in connection with this Merch Promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the extent legally permissible).
General
If any provision in these terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void, or unenforceable) will be struck and not affect the validity and enforceability of the remaining provisions.
Stake may suspend or terminate a Merch Promotion or a user’s ability to participate in it at any time for any reason. We reserve the right to suspend accounts if we notice any activity we believe is abusive, contrary to Stake’s brand values, fraudulent, or in violation of the Stake Terms & Conditions. We reserve the right to review and investigate all referral activities and to suspend accounts or modify rewards in our sole discretion as deemed fair and appropriate.
These Merch Promotion terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia.
We can update these terms & conditions at any time without prior notice. If we modify these terms, we will post the modification on the Stake website & app which are effective upon posting. Continued participation in the applicable Merch Promotion after any modification shall constitute consent to such modification.
