1% Wall St Promotion Terms and Conditions

The 1% Wall St Promotion (Promotion) is run by Stakeshop Pty Ltd (Stake) and is subject to these Terms and Conditions (Promotion Terms and Conditions).

Definitions

Unless specified otherwise, capitalised terms that are not defined in these terms have the meaning given to them in the Stake Terms and Conditions.

Bonus means one percent (1%) of the value of your U.S. securities and USD, calculated by Stake as at the last close price during a regular trading session (i.e. not pre or post-market trade) on the date your U.S. securities and USD are settled in your Stake Wall St account, credited to your Stake Wall St account in USD. The maximum Bonus an Invited Customer may receive for submitting an Eligible Transfer is $US1,000.

Eligible Transfer means a successful Portfolio Transfer submitted by an Invited Customer within the Invitation Period.

Invitation Period means 48 hours from the date and time at which an Invited Customer receives an invitation to participate in the Promotion.

Invited Customer means a Stake customer who receives an invitation to participate in the Promotion from Stake.

Portfolio Transfer means an ACATS or DTC transfer of U.S. securities and USD to your Stake Wall St account. For more information on ACATS and DTC transfer methods, refer to this Stake support article.

Eligibility

The Promotion is available only to a Stake customer who; 

  1. is an Invited Customer; and 

  2. submits an Eligible Transfer; and

  3. receives an email confirmation by Stake that their submission of an Eligible Transfer is accepted.

Invitation

For each Invited Customer who satisfies the eligibility criteria set out in these terms, Stake will deposit the Bonus to their Stake Wall St account within 7 Business Days of the date their U.S. securities and USD are settled in their Stake Wall St account, subject to the Promotion Terms and Conditions.

Stake is not liable to pay any costs associated with a Portfolio Transfer including but not limited to any fees levied by your existing broker or incoming fees (e.g. if transferring via DTC) including in the event the Portfolio Transfer is unsuccessful.

Stake is not liable for any delays or errors that may occur during the transfer process including without limitation any missed market opportunities. 

Restrictions

The Promotion is available to Australian customers only in relation to their individual accounts only. One Bonus opportunity is available per eligible person. Customers cannot set up multiple accounts to claim more than one Bonus opportunity nor can they forward their invitation to other customers to participate.

Stake recommends that you do your own research and consider speaking to a licensed financial adviser to ensure you make informed investment decisions that take into account your personal objectives, financial situation and needs (which Stake does not take into account). 

Termination and Changes

Stake may suspend or terminate the Promotion or a customer’s ability to participate at any time for any reason without prior notice, including during the Invitation Period. Stake reserves the right to suspend accounts or refuse to pay the Bonus if Stake notices any activity it believes is abusive, contrary to Stake’s brand values, fraudulent or in violation of these terms, the Stake Terms and Conditions or the Customer Code of Conduct. Stake reserves the right to review and investigate activities and to suspend accounts or modify the Bonus in its sole discretion as deemed fair and appropriate.

If the Promotion is terminated after you have submitted an Eligible Transfer and received email confirmation from Stake that your Eligible Transfer has been accepted, but before your Portfolio Transfer has settled in your Stake Wall St account, you will still receive the Bonus. 

You will not receive the Bonus if: 

  1. you do not submit an Eligible Transfer during the Invitation Period;

  2. the Promotion is terminated before you submit an Eligible Transfer and your Eligible Transfer is accepted by Stake;

  3. your Portfolio Transfer does not settle into your Stake Wall St account 42 calendar days of the date you submit an Eligible Transfer, you will not receive the Bonus;

  4. you do not respond to requests from Stake for further documents required to effect a Portfolio Transfer within 14 days;

  5. you do not agree to a Portfolio Transfer being processed; 

  6. you cancel a Portfolio Transfer; or

  7. your Portfolio Transfer is unsuccessful for any other reason.

Severability

If any provision in these terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.

Applicable Law

These terms are governed by and constructed in accordance with the laws of New South Wales, Australia and shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Updates to the Promotion Terms and Conditions

Stake can update these terms at any time without prior notice. If Stake modifies these terms, Stake will post the modification on the Stake website and app which are effective upon posting. Continued participation in the Promotion after any modification shall constitute consent to such modification.
