Market Cap Giveaway: Terms and Conditions
The following terms and conditions apply to the ‘Market Cap Giveaway’ Competition (the Competition). By participating in the Competition, you agree to be bound by these terms and conditions (T&Cs), which are in addition to Stake’s Terms and Conditions.
Promoter
The promoter is Stakeshop Pty Ltd (ACN 610105505), C/O BDO, Level 11, 1 Margaret Street, Sydney, 2000, New South Wales, Australia.
Promotional Period
The promotional period is from 10:01 AEST Thursday 28 May 2025 and ends once all prizes have been claimed or at 11:59PM AEST Thursday 4 June 2026, whichever occurs first.
Eligibility
To be eligible to enter the Competition, you must:
be an Australian resident;
be aged 18 years or over; and
have a valid Instagram account.
Officers, contractors, employees and their immediate families of the Promoter or any of its related bodies, corporations, or any of its agencies or contractors involved with this Competition are not eligible to enter the Competition.
How to Enter
During the Promotional Period, entrants must:
Comment on the promotional Instagram post published by @hellostake; and
Tag ten (10) other Instagram users in the comment.
Only one (1) entry is permitted per person.
Bulk, automated, spam or duplicate entries may be disqualified at the Promoter’s discretion.
Winning Criteria
The Competition is a first valid entry promotion.
The first ten (10) eligible entrants who correctly complete the entry requirements during the Promotional Period will each receive one (1) prize.
The Promoter reserves the right to verify the validity of entries and entrants and to disqualify any entrant who tampers with the entry process or submits an entry that is not in accordance with these T&Cs.
The Prize
Each winner will receive one (1) blue edition Market Cap.
There are ten (10) prizes available in total.
The total prize pool value is approximately AUD $350.
Prizes are not transferable, exchangeable or redeemable for cash.
The winners will be notified via Instagram Direct Message from @hellostake within seven (7) days of being determined as a winner.
The winners must respond within seventy-two (72) hours of notification and provide any information reasonably requested by the Promoter for prize fulfilment purposes, including proof of age and Australian residency if requested.
If a winner does not respond within the required timeframe, the Promoter reserves the right to award the prize to the next eligible entrant.
Prize Delivery
Prizes will only be delivered to Australian addresses.
The Promoter is not responsible for any lost, delayed or damaged deliveries once dispatched.
Privacy
By entering the Competition, entrants consent to the Promoter collecting and handling their personal information in accordance with Stake’s Privacy Policy for the purposes of administering the Competition and delivering prizes.
No Affiliation
By participating in this Competition, you agree to release Instagram from any responsibility in respect of this Competition.
You also acknowledge that the Competition is in no way sponsored, endorsed or administered by, or associated with Instagram.
No Advice
This Competition does not constitute financial advice, nor a recommendation to invest in certain financial products. We recommend that you do your own research and consider your own financial needs, objectives and circumstances before making any investment decisions.
Limitation of Liability
Stake will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage, whether or not arising from any person’s negligence or wilful misconduct, in connection with this Competition or accepting or using any prize, except for any liability which cannot be lawfully excluded, in which case that liability is limited to the extent legally permissible.
General
Severability
If any provision in these terms is held to be invalid, void, or unenforceable, such provision (or the part making it invalid, void or unenforceable) will be struck out and will not affect the validity and enforceability of the remaining provisions.
Suspension and Termination
Stake may suspend or terminate the Competition or a user’s ability to participate in the Competition at any time for any reason.
Stake reserves the right to review and investigate all activities related to the Competition and to disqualify any entrant who breaches these T&Cs or engages in conduct which is fraudulent, misleading, deceptive, offensive, defamatory, unlawful or otherwise damaging to the goodwill or reputation of Stake or the Competition.
Jurisdiction
These T&Cs are governed by and constructed in accordance with the laws of New South Wales, Australia and are subject to the exclusive jurisdiction of the courts of New South Wales.
Updates to these T&Cs
Stake may update these Competition T&Cs at any time without prior notice by publishing the updated version on its website. Continued participation in the Competition constitutes acceptance of any updated T&Cs.
